Please note that the only way to serve documents is NOT necessarily by the use of the Central Authority, there are alternative private serving manners proposed by Art. 10, 5 and 8 that can bypass the bureaucracy of the "Central Authority". These channels are faster and more reliable. Service of Process outside the Hague Convention is also possible by Legal Courier and not necessarily by International reciprocity, but as per Federal regulation 4. Note also that if a country opposes to the direct application of article 10 methods during their adhesion to the treaty, then you can apply article 5 and ask for an authorization to use these methods of article10. Our reputation; We have never been refused such special permission from a Central Authority. Often is very practical and is recommended making a parallel to service to that already requested to the Central Authority since the Central Authority often fails to serve.
The use of the Central Hague Convention's Authorities is not mandatory nor exclusive (file A is the full text of the Hague Convention) see Art. 8 which as Article 5 and 10 a,b and c are alternative channels for private personal service. Article 8 can not be used by the North American Jurisdictions and Art. 5 is often automatically permitted, without express request when the Central Authority fails to serve, indeed it is recommended that when you apply for service to the Central Authority to ask in advance and for eventualities the designation of Joseph A. de LA CUETARA (Barrister-Solicitor), to serve immediately by Article 10 as per Article 5. Thereto, the methods proposed for Private Personal Service by the Convention and from North America are two;
One, by the use of the Central Authority. You will need to translate your documents and often pay advance the fees, it often fails and when it fails you can use Article 5 (2) to hire our services, so submit your letter of application and do not waist your precious legal time.
Two, by a “Private Service provider” as contemplated in Article 10 a,b and c. You do not need to translate your documents and is immediately completed. Our fee are flat fees all included (In application of Article 5 in front of a failure, if you want to use our Services and for the Central Authority to pay us or the Court to pay our fees you have to ask them expressly to name us as special process servers and you will have to advance our fees. Please note that the downside of Article 5(2), to use the methods propose in article 10; it is necessary voluntary acceptance of addressee (Using direct service by Article 10 does not requires voluntary acceptance of addressee but a signature of reception or waiver of voluntary acceptance is useful).

Our flat fees include everything, Affidavit of Service authenticated by diplomats, mail, copies ..... evidence... these prices are established according to the kind of server. The main difference is “serving time”, from "As soon as Possible" (48/72 hrs) to 15 days. Please note that as per the Hague Apostille Convention of 1961 our signature does not require authentication of Notaries since we are Judicial Officers, equivalent to the Central Authority, see Article 1 a of the Apostille Convention.
We offer other possibilities for service but we recommend International Private Personal Service a per Article 10, because we guaranteed this service in court against any motion to quash.
Our membership to Law Societies or Bar Associations offer the necessary international guarantees and respect for local and foreign laws of Procedure and because we are Attorneys at law, Barristers Solicitors, Judicial Officers or bailiffs.... we do not use intermediaries, we respond to you directly and to your judging court by an Affidavit of Service in English language authenticated.
The Central Authority confirmation or Affidavit (file c) is not necessary and is redundant, causes delays and requires translations but if you require so, in some Countries the Central Authority will issue their Affidavit of Service confirming our "International Private Personal Service of Process", this is almost automatic when service is originated in article 5.Our oun Affidavits of Service are very complete and have legal back up documentation, we always try to include evidence of service .
When using our International Private Personal Service of Process, as proposed, you do not need to translate your documents and our server will explain the International Procedures to follow to respond to service, assuring that defendant is not “defenselessness”, we make sure that "Confidentiality" and "legality" are respected.
