Non Hague International Process Servers

Using International Treaties is not the only and exclusive way to serve documents abroad,or the only method accepted by a Court, there are other legal ways, in fact, acceptance of International Service of process relies on your jurisdiction, Federal laws invite to use the fastest method available. When serving in a  Jurisdiction that is a none signatory country of the Hague Convention or that opposes to application of Article 10, you can use other International legal techniques  for "International service of process" such as obtaining from your court a judicial mandate naming us as "Special International Process Server" or simply having the Process Server obtain the signature of defendant on waiver or a "Voluntary Service Acknowledgment Receipt" or "Submission to that jurisdiction" .

On the other hand, you can "simply serve" if defendant is a national of the Judging Jurisdiction and if surrounding that service, of the necessary "reasonable legal guarantees" to prevent any "International service quash", "Motion to Quash" for violating internal laws of procedure. In other words: Acceptance of International service relies in what "service of Process Legal guarantees" you will present to your judging court and no court can accept an Illegal act in a foreign Jurisdiction.

We also complete "Parallel Service of Process" to the Hague Convention's Central Authority service, this double service is of  International Courtesy and a preventive measure.

Our Service of Process guarantees are subjective and objective:

A. Subjective;
1. Our Server: A Legal professional, a registered and insured Barrister-Solicitor and Judicial Officer, bind by an ethical code of conduct, member of a professional association, oblige to confidentiality, neutrality and integrity and who will guarantee his sworn statements or affidavits of service in any Court of any country.
2. The Legal action: Defendant being a foreigner or not, national or resident of the country where judgement take's place, has as only requirement his "link" to the case and must not find himself in a "defencelessness" situation meaning that his rights have to be respected in the Judging Jurisdiction as well as in the Serving Jurisdiction.

B. Objective;
1. Form: Must also respect local and foreign laws of Civil procedure. A defendant can be served in his "Place of work", "home", "Office" but only if respecting certain legal limitation. Privacy, Confidentiality, Authenticity and non defencelessness principles are again necessary as much as an essential element "legal professional advise" on International Procedure to follow to respond to service properly.
2. The Affidavit of service: Must be signed by a person that can be properly  identified and "bind to the judging jurisdiction", such as a U.S. Citizen for a U.S. or Canadian, thereto his sworn statement must be "valid", legalised by the diplomatic representation of the Country where judgement take's place. In Jurisdictions that are not "Common law" and affidavit of service carries no criminal responsibility and in some not even civil liability.
3. The Documents served: Must be a "true copy" preceded by an Attorney letter indicating contents and if possible time to respond, consequences of not responding, how to access legal Aid in the Judging Jurisdiction and controlled.

These prices are all included, Attorney legal advise to defendant, Service of Process, Authentication of an Affidavit in English... and Etceteras. Our prices vary according to the subject being served: Corporations or Individuals, also “time to serve”, in Personal service A, service is "As soon as Possible" (48/72 hrs) and in personal B, service is completed within 30 days.

The legal form resulting from our service, is an Affidavit of Service in English authenticated by a Consular Agent.
